technically, is it illegal for any reason to sell a jailbroken ipod that still has all your songs on it?

im selling my jailbroken ipod which has a few thousand songs on it is there any reason i could get in trouble for selling it with my songs still on it?
So does that mean it’s even illegal to give your friend a used cd? Wouldn’t that make selling used CDs in stores and music on eBay illegal?

    Yes. It is a violation of copyright.

    When you “buy” songs off iTunes you are technically buying a transferable license. You do not own the songs, and cannot sell them.

    If you copied the songs from CD’s the law is just as clear. It is legal to make a copy of a song you have bought, for your own use only. As soon as you buy it - or give it away - it’s illegal.

    If you do not keep a copy of any of the songs on the iPod, it would be legal. You don’t really buy a song, you buy a license to listen to that song for your own personal use only. This goes for CD’s and digital (iTunes) songs you purchase.

    *EDIT* - You can give CD’s away or sell used CD’s as long as you do not keep any copies of the music for your use.
